What is a DUI?

A DUI or Driving Under the Influence of Alcohol is a criminal offense.  Drugs, alcohol, and any other controlled substance that impairs driving (even legally prescribed medicine), can get you arrested if the police suspect you are impaired when they encounter you.  People commonly hear the terms DUI and DWI used interchangeably, but in Maryland they have distinct definitions and penalties.

The primary way that you can be convicted of DUI in Maryland is if it is proven that you operated a motor vehicle with a Blood Alcohol Content (“BAC”) in the body equal to or greater than 0.08%.

What is DWI?

A DWI has a lesser penalty than DUI.  The legal definition essentially requires proof that you were “impaired” but not necessarily “under the influence.”  If you refuse to provide breath or blood evidence to the police, you can still be convicted of DUI or DWI, based on any other evidence obtained by the police.

 

What are the penalties for impaired driving?

Jail Time

A first offense conviction for DUI carries a maximum possible penalty of 1 year in jail.

A first offense conviction for DWI carries a maximum possible penalty of 60 days in jail.

Probation and community service are also regularly imposed upon you.

Subsequent convictions for DUI or DWI can carry enhanced penalties.

Fines and Fees

You will have to pay fines and court fees if convicted of a DWI or DUI. The maximum fine for DUI in Maryland is $1,000, and the maximum fine for DWI is $500. Police routinely also charge you with multiple other traffic citations in addition to DUI or DWI.

Suspension or Loss of License

Your driving record can be marked with twelve (12) points for a DUI conviction, or eight (8) points for a DWI conviction, and your license can be revoked or suspended as a result.  Your license can also be administratively suspended before you go to court, simply based on the evidence during your arrest.  It is critical to talk to a lawyer immediately after your arrest to avoid losing your license.

Drug or Alcohol Treatment

A state-mandated alcohol and substance abuse assessment can be ordered. A drug or alcohol treatment program may be prescribed based on the results of your evaluation. Support groups such as Alcoholics Anonymous

Increased Insurance Costs

SR-22 insurance may be required of you once you get your license back. Your premiums may be doubled or tripled, depending on your state’s laws. The premiums for three years will be higher on average.

Ignition Interlock Device

The Maryland MVA or the Court may also mandate ignition interlock devices to be installed on your vehicle.  A breathalyzer must be used to determine whether you have not consumed alcohol before starting the vehicle with this device. This program requires a monthly monitoring fee, along with device installation fees.
