Jury Acquittal in Prince George’s County.

        • After a four-day jury trial in Prince George’s County, a jury acquitted Mr. Jezic’s client of several sex offenses, and was hung on only one charge. The State’s case was strong, but attorney David Hollenberg and Andrew Jezic called more witnesses than the prosecution, and prevailed after long, passionate closing arguments.

          • In April 2017, David Moyse convinced a Howard County judge to suppress an unlawful detention of his client, leading to a Judgment of Acquittal on charges of Resisting Arrest and Disorderly Conduct.  The Judge found that police officers had no constitutional justification for detaining a man in his vehicle, and suppressed the remainder of the case.

April, 2017

          • Attorney David Moyse obtains full acquittal in DUI jury re-trial.

            The Defendant admitted to consuming 16 beers over a 24 hour period, but a jury returned a unanimous verdict of not guilty following about two hours of deliberation.  The first trial in this case was declared a mistrial, after jurors could not reach a unanimous verdict.

          • Attorney Carolyn Demougeot convinces a judge to throw out a confession and then wins the case.

            In March 2017, Carolyn Demougeot convinced a Prince George’s County judge to suppress her client’s confession, leading to a Judgment of Acquittal on all charges, namely possession of over 60g of marijuana.  The Judge found that police officers did in fact have an obligation to mirandize her client while they had him under custodial detention on the side of the side of the road

          • Hung Jury Leads to Dismissal of Incarcerable Charges.

            In December 2016, a Montgomery County jury deliberated for over six hours before the Court found they were deadlocked and a mistrial was declared.  Mr. Moyse’s client testified credibly that she was emotional following the conclusion of her divorce, and not intoxicated, as was described by three different police officers.  Comments from the jurors, and evaluation of the cross-examination in the first trial led prosecutors to dismiss the DUI offenses, and the client paid a ticket for reckless driving.

          • 23 year old State Department employee acquitted of DUI. 

            In December 2016, a Montgomery County jury came back with a Not Guilty verdict for DUI and DWI, in a case where a young man’s security clearance and career were at risk.  Prosecution witnesses testified that the Defendant was extremely intoxicated, belligerent, and unable to maintain his balance.  However, Moyse’s lengthy cross-examination revealed a different side to the story.  In all, the jury took just an hour to unanimously declare the Defendant Not Guilty.

          • Jezic Scores Two Jury Acquittals in Two DWI Trials.  First, a Prince George’s County jury acquitted a radiological technician of DWI despite the officer’s testimony that Mr. Jezic’s client failed the field sobriety tests. A few weeks later, a Montgomery County jury acquitted Mr. Jezic’s client of DWI despite the officer’s testimony that the driver was “absolutely hammered.”

April, 2016

          • Complete Acquittal in First-Degree Assault Trial.

Maryland defense Attorney David Moyse obtained a complete acquittal for a client accused of stabbing another man in the eye with a screwdriver. Moyse’s client was found running from the scene with a screwdriver next to him. The bloody screwdriver was tested to have the victim’s DNA, and the victim’s blood was found on the Defendant’s shirt.

However, the jury deliberated for only 1.5 hours, concluding the the victim, and another State’s witness were simply not believable. Moyse’s client was found not guilty on all charges.

          • Jury Acquits Man Facing Second DUI Conviction and Loss of Immigration Status.

A Haitian immigrant facing his second DUI conviction in 3 years was acquitted by a Montgomery County jury on January 20, 2016.

Attorney Rand Lucey was able to convince jurors that his client – who had been sitting behind the wheel of a running car with a .12 BAC – was simply using the vehicle as shelter and did not intend to drive at the time he was arrested.

The stakes were particularly high for the client, as a conviction would have subjected him to deportation after 25 years in the United States.
